Mayor DeViet to call the meeting to order at 6:30 p.m.

In response to COVID-19 we continue to hold Council meetings electronically.  The municipal office is closed however members of the public are invited to participate in this meeting of Council electronically by accessing the meeting  which will be live-streamed on our YouTube channel:

The Public Meetings for Planning applications will begin at approximately 7:00 p.m.

The Municipal Conflict of Interest Act requires any member of Council declaring a pecuniary interest and the general nature thereof, where the interest of a member of Council has not been disclosed by reason of the member’s absence from the meeting, to disclose the interest at the first open meeting attended by the member of Council and otherwise comply with the Act.​
  • THAT the minutes of the Middlesex Centre Council meeting held on June 10, 2020 be adopted as printed.

  • THAT the Council for the municipality of Middlesex Centre receives the consent items 6.1 and 6.2 as information and approves the recommendations as contained in the reports.

  • THAT report CPS-33-2020 outlining the COVID-19 municipal financial impacts update for June 2020 be received for information.

  • THAT through Section 57 of the Ontario Drainage Act, Council refer the Engineer’s Report for the Pfister Municipal Drain Petition back to the Engineer for reconsideration;

    AND THAT The Court of Revisions for the Pfister Municipal Drain scheduled for July 15th, 2020 be cancelled and removed from the agenda.

  • THAT consent application B-32/19, filed by Zelinka Priamo (c/o Harry Froussios) on behalf of 5005559 Ontario Inc. in order to sever a surplus farm residence on a lot with a frontage of approximately 70.5 meters (230 ft) along Ilderton Road (County Road 16) and an area of approximately 0.667 hectares (1.64 ac); from a property legally described as Part Lot 23, Concession 11 (geographic Township of London), and municipally described as 14378 Ilderton Road and 22740 Richmond Street, Municipality of Middlesex Centre; be DENIED.

    AND THAT the reasons for denying Consent Application B-32/19 include:

    • The proposal is not consistent with the Provincial Policy Statement; and
    • The proposal does not conform to the County of Middlesex Official Plan and the Middlesex Centre Official Plan.

    AND FURTHER THAT the Zoning By-law Amendment application, Zelinka Priamo (c/o Harry Froussios) on behalf of 50055599 Ontario Inc. for the severed lands of Consent B-32/19 in order to implement the severance of a surplus farm residence, be DENIED.

  • THAT Consent Application B-12-20, filed by Dale Cook, on behalf of Mrs Donna Paulter in order to sever a surplus farm residence on a lot with a frontage of approximately 46.67 m (153.1 ft) on Fifteen Mile Road and an area of approximately 1.0 ac (0.4 ha) and the retained having a frontage of approximately 55.40 m (181.7 ft) on Fifteen Mile Road and an area of approximately 28.6 ac (11.59 ha), from a lot legally described as Part of Lot 5, Concession 15 S, in the Township of Middlesex Centre, County of Middlesex; be GRANTED.

    AND THAT Consent B-12/2020 be subject to the following conditions:

    1. That the Certificate of Consent under Section 53(42) of the Planning Act shall be given within one year of the date of the notice of the decision. The request for the Certificate of Consent shall be accompanied by a written submission that details how each of the conditions of severance has been met.

       

    2. That the fee for the Certificate of Consent be paid in accordance with the Municipality’s Fees and Charges By-law.

       

    3. That a draft reference plan be prepared by an Ontario Land Surveyor for the purposes of facilitating the transaction of Consent B-12/2020 and that this plan be approved by the Municipality prior to being deposited with the Land Registry Office.

       

    4. That the Owner’s solicitor provide a Transfer in Preparation to the Municipality, together with a deposited reference plan and a Schedule describing the land to be transferred, for the purposes of the issuance of a Certificate of Consent.

       

    5. That the Owner’s solicitor submit an undertaking in a form satisfactory to the Municipality to register an electronic transfer of title consistent with the Consent decision.

       

    6. That the Owner enter into a severance agreement with the Municipality in order to advise future owner of the severed lot of Consent B-12/2020 of normal farm practices occurring in the area as outlined in the Farming and Food Production Protection Act, 1998, as amended.

       

    7. That any outstanding property taxes for the severed and retained lots of Consent B-12/2020 be paid in full.

       

    8. That, if necessary a revised assessment schedule in accordance with the Drainage Act, as amended, be commissioned and paid for by the Owner.

       

    9. That a Zoning By-law Amendment that recognizes the residential use of the severed lot and prohibits residential use on the retained lot of Consent B-12/2020 be in full force and effect.

       

    10. That the Owner provide confirmation that the private sewage disposal system that services the residence on the severed lot of Consent B-12/2020 is wholly contained on the said lot and that a 100% contingency area exists, to the satisfaction of the Municipality.

       

    11. That the Municipality be satisfied that the shared well agreement with the neighbouring property remain in full force and effect once a transfer of lands occurs or that the Owner be required to obtain private water services on the lands.

       

    12. That the Owner be required to remove one of the existing driveways to the severed property to the satisfaction of the Municipality.

       

    13. That the lands be transferred to Dale Cook and proof of transfer is provided to the satisfaction of the Municipality.

    AND FURTHER THAT the reasons for granting Consent Application B-12/2020 include:

    • The proposal is consistent with the Provincial Policy Statement;
    • The proposal conforms to the County of Middlesex Official Plan and the Middlesex Centre Official Plan; and
    • Subject to the conditions, the proposal would comply with the Middlesex Centre Comprehensive Zoning By-law.

  • THAT Consent Applications B-13/2020, Cale Barnes on behalf of Jordan D. Caranci, in order to sever a residential lot with a frontage of approximately 15.24 m (50 ft) on Ilderton Road and an area of approximately 766.45 m2 (8249.9 sq ft), and the retained is to have a frontage of approximately 17.07 m (56 ft) on Ilderton Road with an area of 858.42 m2 (9239.9 sq ft) on a property legally described as Part of Lot 26, Concession 11 (geographic Township of London), Municipality of Middlesex Centre and, Municipally known as 13154 Ilderton Road; be GRANTED.

    AND THAT Consent B-13/2020 be subject to the following conditions:

    1. That the Certificate of Consent under Section 53(42) of the Planning Act shall be given within one year of the date of the notice of the decision.     7. That the Owner provides a lot grading pan prepared by a Professional Engineer that includes appropriate grades at property boundaries and the four corners of a building envelope. The lot grading plan shall indicate a suitable building area that meets the required setbacks from the overhead electrical lines servicing neighbouring properties. The electrical lines and setbacks shall be shown on the grading plan.

    8. That the Owner enter into a Development Agreement with the Municipality, and that the Agreement be registered against the title of the subject land, to address among other matters: all financial, legal, planning and engineering matters including but not limited to payment of the Municipality’s engineering, legal and planning review costs, entrance locations and construction, works within the road allowance, lot grading and drainage plans, and building envelopes, all to the satisfaction of the Municipality.

    9. That the owner install separate water, storm, and sanitary service connections to the severed parcel at the expense of the Owner prior to consent being granted to the satisfaction of the Municipality.

    10. That if necessary, the owner relocate the existing water and sanitary services be wholly contained on the retained lands to the satisfaction of the municipality.

    11. That the Owner be required to pay to the Municipality $6,143.00 for the purposes of funding 50% of the future municipal road reconstruction costs of Ilderton Road to an urban standard along the frontage of the severed lot of Consent B-13/2020, inclusive of curbs sidewalks and street lighting.

    12. That the Owners pay $1,000 cash-in-lieu of parkland dedication for the proposed lot of Consent B-13/2020.

    13. That the Owner provides confirmation from an Ontario Land Surveyor that the residence on the retained lot of Consent B-13/2020, known municipally as 13154 Ilderton Road, will meet the minimum Zoning By-law setback from the new lot line created by Consent B-13/2020. Should the minimum setback not be met, the Owner agrees to file for the review and consideration of the Municipality’s Committee of Adjustment, a Minor Variance application in order to achieve compliance with the Zoning By-law.

    14. That the Owner removes or otherwise re-locates the existing accessory building (detached garage) to meet the minimum Zoning By-law setback from the new lot line created by Consent B-30/17 to the satisfaction of the Municipality.

    15. That, if applicable, the Minor Variance required by condition 12 be in full force and effect.

    16. That the owner will be required to dedicate lands up to 15 m from the centerline of construction of County Road 16 (Ilderton Road) to the County of Middlesex across the severed and retained parcels for the purposes of road widening if the right of way is not already to that width.

    AND FURTHER THAT the reasons for granting Consent application B-13/2020 include:

    • The proposal is consistent with the Provincial Policy Statement;
    • The proposal conforms to the County of Middlesex Official Plan and the Middlesex Centre Official Plan; and
    • The proposal complies with the Middlesex Centre Comprehensive Zoning By-law.
  • THAT Council do now close the Public meeting and go back into the regular meeting of Council. 

  • THAT the Middlesex Centre Council meeting for June 24, 2020 be adjourned at ______.
