Mayor DeViet to call the meeting to order at 9:30 a.m.

Members of the public are invited to participate in this meeting of Council by accessing the meeting which will be live-streamed on our Middlesex Centre YouTube channel.

The Municipal Conflict of Interest Act requires any member of Council declaring a pecuniary interest and the general nature thereof, where the interest of a member of Council has not been disclosed by reason of the member’s absence from the meeting, to disclose the interest at the first open meeting attended by the member of Council and otherwise comply with the Act.

  • THAT Council adjourn its regular meeting in order to sit as the Court of Revision under Section 97 of the Drainage Act, as amended, to consider the Vande Borne Drain with members Councillor Heffernan, Councillor Shipley and Deputy Mayor Brennan in the Chair;

The Engineer's Report for the Vande Borne Drain was previously considered at the September 8, 2021 meeting of Council.

The Court of Revision will proceed as follows:

1. CALL TO ORDER

All appeals are required to be received in writing 10 days prior to the date of the Court of Revisions as per the notice provided. 

2. ORDER OF APPEALS - no appeals received 

3. QUESTIONS FROM THE MEMBERS

Members of the Court of Revision may ask questions of the Engineer or staff. 

4. DELIBERATIONS OF THE COURT OF REVISION

The Court of Revision members (if required) will retreat to deliberate the appeals and make the decision in private. 

If the Court is considering reducing an assessment adding it to a property whose owner is not present, then the Court of Revision will adjourn and notice sent to the absent parties to allow them to appeal the change, then reconvene per s. 53 of the Act. 

5. DECISION

All parties to the drain will receive written notice of the Court of Revision decision which will contain additional information on the process to appeal the decision of the Court of Revision to the Ontario Drainage Tribunal.

6. ADJOURNMENT OF THE COURT OF REVISION

  • THAT the Middlesex Centre Court of Revision approves the Schedule of Assessment for the Vande Borne Drain adopted by By-Law 2021-087 as outlined in the report prepared by Spriet Associates.

  • THAT the minutes of the Middlesex Centre Council meeting held on September 22, 2021 be adopted as printed.

Items listed under the Consent Agenda are considered routine and may require discussion but no action on the part of Council. Consent items are received in one motion. Council members may request that one or more item be removed for further action.

  • THAT Items 7.1 through 7.8 listed on the Consent Agenda for October 13, 2021 be adopted as recommended.

  • THAT Report CAO-23-2021 re: Continuous Improvement 2021 Year-End Review be received for information

  • THAT Report CAO-26-2021, re: Municipal Modernization Program – Intake 3 be received;

    AND THAT the CAO and Treasurer continue with the submissions as outlined in Report 26-2021 to proceed with the identified projects.

  • THAT the Budget to Actual Report CPS-46-2021 for September 2021 be received as information.

  • THAT Report CPS-47-2021 outlining the COVID-19 municipal financial update for Q3 2021 be received for information.

  • THAT Report CPS-48-2021, the 2022 OPP Annual Billing Statement be received for information.

  • THAT the Petition for drainage submitted by a landowner proceed;

    AND THAT staff be directed to notify the affected landowners and appropriate agencies of the Council’s decision to proceed with the drainage works;

    AND FURTHER THAT following the notice to the appropriate agencies, Mike DeVos, P.Eng of Spriet Associates be appointed to prepare a Drainage Report for the creation of a new Municipal Drain, all in accordance with the Ontario Drainage Act.

  • THAT Report PLA 86-2021 re: ‘Information Report – for Ontario Land Tribunal Files PL200502 and PL200503 for Applications for Consent B-32/19 and Zoning By-law Amendment ZBA 29 2019 relating to the property municipally known as 14378 Ilderton Road & 22740 Richmond Street’ be received;

    AND THAT the Clerk assign a by-law number to the Ontario Land Tribunal approved Zoning By-law Amendment;

    AND THAT on January 6, 2021, Council for the Municipality of Middlesex Centre provided the Chief Administrative Officer with direction and authority to endorse Minutes of Settlement in PL200502 and PL200503 in the event the particulars set out in the Minutes of Settlement dated April 16, 2021 were agreeable with the Appellant;

    AND FURTHER THAT Council approves the Severance Agreement and directs for it to be endorsed by the Municipality.

  • THAT Report CLK-015-2021 re: 2022 Council Meeting Schedule be received;

    AND THAT the 2022 Middlesex Centre Council meeting schedule attached as Appendix 'A' be approved.

  • THAT Report CAO-25-2021 re: Proof of COVID-19 Vaccination Policy be received;

    AND THAT the Policy appended to Report CAO-25-2021 be adopted.

  • THAT Report CAO-24-2021 re: Funding of Watermain Extension on Longwoods Road be received;

    AND THAT the amount of $60,000 be provided for the purposes of the watermain extension along Longwoods Road to support development;

    AND THAT the amount of $60,000 be withdrawn from the Delaware Hydro Reserve Fund;

    AND FURTHER THAT future development revenues realized from this watermain extension be reinstated back to the Delaware Hydro Reserve Fund.

  • THAT Report PWE-33-2021, re: Kilworth wastewater demolition single source be received;

    AND THAT the Municipality single source the engineering consultant (design, acquisition of approvals, contract administration, contract tendering, site servicing and site inspections) portion of the project for the decommissioning and demolition of the Kilworth Wastewater Treatment Facility to MTE in the amount of $108,305.60 + HST.

  • THAT Council receive for information Report PWE 30-2021 Gravel Road Conversion Policy;

    AND THAT Council endorse the Gravel Road Conversion Policy as found in Appendix B.

  • THAT the Council for the Municipality of Middlesex Centre receives the Correspondence item [item numbers] as information.

  • THAT the Council for the Municipality of Middlesex Centre adjourn to closed session at ___ pursuant to Section 239 (2) of the Municipal Act, 2001, as amended to discuss the following matters:

    Section 239 (2)(a)  the security of the property of the municipality or local board;

    Section 239 (2)(b)  personal matters about an identifiable individual, including municipal or local board employees;

    Section 239 (2)(c)  a proposed or pending acquisition or disposition of land by the municipality or local board;

    Section 239 (2)(e)  litigation or potential litigation, including matters before administrative tribunals, affecting the municipality or local board.
