CALL TO ORDER

Mayor DeViet to call the meeting to order at 9:30 a.m.

Members of the public are invited to participate in this meeting of Council by accessing the meeting which will be live-streamed on our Middlesex Centre YouTube channel or by contacting the Municipal Clerk to receive a registration link to join the meeting electronically.

Members of the public may also attend the meeting in-person at the Ilderton Community Centre located at 13168 Ilderton Rd, Ilderton, ON N0M 2A0

LAND ACKNOWLEDGEMENT

The Municipality of Middlesex Centre recognizes that we are gathering on the traditional territory of the Anishinaabe, Haudenosaunee, and Leni-Lunape Peoples. We acknowledge the enduring presence of First Nation, Métis and Inuit people on this land and are committed to moving forward in the spirit of reconciliation and respect.

Our neighbouring First Nations communities which continue to live as sovereign Nations include the Chippewas of the Thames First Nation, Oneida Nation of the Thames, and Munsee Delaware Nation.

DISCLOSURE OF PECUNIARY INTEREST

The Municipal Conflict of Interest Act requires any member of Council declaring a pecuniary interest and the general nature thereof, where the interest of a member of Council has not been disclosed by reason of the member’s absence from the meeting, to disclose the interest at the first open meeting attended by the member of Council and otherwise comply with the Act.

COURT OF REVISION

• THAT Council appoint Councillor Heffernan as a member to the Court of Revision for the Fisher Watt drain as a replacement for Councillor Aerts;

  AND THAT Council adjourn its regular meeting at ______ a.m. to sit as the Court of Revision. Members of the Court of Revision are Deputy Mayor Brennan, Councillor Heffernan, and Councillor Shipley, with Deputy Mayor Brennan being the Chair.

5.1

Court of Revision for the Fisher Watt Drain

The Engineer's Report for the Fisher Watt Municipal Drain Culvert was previously considered at the January 24, 2024 meeting of Council. Members of the Court of Revision are Deputy Mayor Brennan, Councillor Aerts, and Councillor Shipley, with Deputy Mayor Brennan being the Chair.

The Court of Revision will proceed as follows:

1. CALL TO ORDER

All appeals are required to be received in writing 10 days prior to the date of the Court of Revisions as per the notice provided. 

2. ORDER OF APPEALS - no appeals received 

3. QUESTIONS FROM THE MEMBERS

Members of the Court of Revision may ask questions of the Engineer or staff. 

4. DELIBERATIONS OF THE COURT OF REVISION

The Court of Revision members (if required) will retreat to deliberate the appeals and make the decision in private. 

If the Court is considering reducing an assessment adding it to a property whose owner is not present, then the Court of Revision will adjourn and notice sent to the absent parties to allow them to appeal the change, then reconvene per s. 53 of the Act. 

5. DECISION

All parties to the drain will receive written notice of the Court of Revision decision which will contain additional information on the process to appeal the decision of the Court of Revision to the Ontario Drainage Tribunal.

6. ADJOURNMENT OF THE COURT OF REVISION

• THAT the Middlesex Centre Court of Revision approves the Schedule of Assessment for the Fisher Watt Municipal Drain provisionally adopted by By-Law 2024-009 as outlined in the report prepared by Spriet Associates;

  AND THAT the corresponding by-law be forwarded to Council for a final reading;

  AND FURTHER THAT the Court of Revision adjourn at ____ a.m. and Council resume their regular meeting.

Middlesex County OPP Policing Summary for 2023

Inspector Ross Stuart, Detachment Commander, will be in attendance to provide an overview of the OPP policing summary for 2023.

Todd Copeland will be in attendance on behalf of Community Futures Middlesex to provide an update presentation.

• THAT the minutes of the Middlesex Centre Council meeting held on February 21, 2024 be adopted as printed.

• THAT Report CPS-15-2024, re: Capital Budget to Actual Q4 2023 preliminary report be received as information.

8.7

Needham-Moir Drainage Works Request for Drain Improvement

• THAT the Request for Drain Improvement submitted by landowners proceed;

  AND THAT staff be directed to notify the affected landowners and appropriate agencies of the Council’s decision to proceed with the drainage works;

  AND FURTHER THAT following the notice to the appropriate agencies, Mike DeVos, P.Eng. of Spriet Associates be appointed to prepare a Drainage Report for the improvement of the requested Municipal Drain, all in accordance with the Ontario Drainage Act.

Establishment of Middlesex Centre Economic Development Advisory Committee (EDAC)

• THAT Report CLK-02-2024 re: Establishment of Middlesex Centre Economic Development Advisory Committee (EDAC) be received;

  AND THAT the Council for the Municipality of Middlesex Centre resolve to establish a Middlesex Centre Economic Development Advisory Committee (EDAC);

  AND THAT the Middlesex Centre Economic Development Advisory Committee (EDAC) terms of reference attached hereto be approved;

  AND THAT Councillor __________ and Councillor _______ be appointed as municipal council representatives to the Committee for the duration of the 2022-2026 term of Council;

  AND FURTHER THAT the Municipal Clerk be directed to advertise for interested public representatives in accordance with the membership criteria contained in the Committee terms of reference.

Association of Municipalities of Ontario - Social and Economic Prosperity Review

• WHEREAS the current provincial-municipal fiscal arrangements is weakening Ontario’s economic prosperity and quality of life;

  WHEREAS nearly a third of municipal spending in Ontario is for services in areas of provincial responsibility and expenditures are outpacing provincial contributions by nearly $4 billion a year;

  WHEREAS municipal revenues, such as property taxes, do not grow with the economy or inflation;

  WHEREAS unprecedented population and housing growth will require significant investments in municipal infrastructure;

  WHEREAS municipalities are being asked to take on complex health, social and infrastructure challenges;

  WHEREAS inflation, rising interest rates, and provincial policy decisions are sharply constraining municipal fiscal capacity;

  WHEREAS property taxpayers – including people on fixed incomes and small businesses – can’t afford to subsidize income re-distribution programs for those most in need;

  WHEREAS the province can, and should, invest more in the prosperity of communities;

  WHEREAS municipalities and the provincial government have a strong history of collaboration;

  THEREFORE, BE IT RESOLVED THAT the Municipality of Middlesex Centre calls upon the Province of Ontario commit to undertaking with the Association of Municipalities of Ontario a comprehensive social and economic prosperity review to promote the stability and sustainability of municipal finances across Ontario;

  AND FURTHER THAT a copy of this motion be sent to the Premier of Ontario ([e-mail]); Minister of Municipal Affairs and Housing ([e-mail]); the Minister of Finance ([e-mail]); and to the Association of Municipalities of Ontario ([e-mail]).
