Mayor DeViet to call the meeting to order at 5:30 p.m. Members of the public are invited to participate in this meeting of Council by attending the meeting in-person at the Ilderton Community Centre located at 13168 Ilderton Rd, Ilderton, ON N0M 2A0.


Members of the public may also access the meeting which will be live-streamed on our Middlesex Centre YouTube channel or by contacting the Municipal Clerk to receive a registration link to join the meeting electronically.


Members of the public wishing to appear as a delegation can register for the meeting by visiting middlesexcentre.ca/participating-council-meetings or by contacting the Municipal Clerk at (519) 666-0190 by 4:30 p.m. on the Monday of the week of the scheduled meeting. All requests to delegate are subject to the provisions of the Middlesex Centre Procedure By-law.


Members of the public can choose to delegate in-person or by electronic participation. Accessible formats and communication supports are available upon request.

The Municipal Conflict of Interest Act requires any member of Council declaring a pecuniary interest and the general nature thereof, where the interest of a member of Council has not been disclosed by reason of the member’s absence from the meeting, to disclose the interest at the first open meeting attended by the member of Council and otherwise comply with the Act.

  • THAT the minutes of the Middlesex Centre Council meeting held on February 12, 2025 be adopted as printed.

Items listed under the Consent Agenda are received in one motion. Council members may request that one or more item be removed for further action.

  • THAT Consent items 6.1 through 6.9 listed on the February 29, 2025 agenda be adopted as recommended.

  • THAT Report CPS-07-2025 re: Middlesex Centre Customer Service Overview, 2024 be received for information.

  • THAT the Budget to Actual Report CPS-08-2025 for January 2025 be received as information.

  • THAT Report CPS-10-2025, re: YMCA Surplus 2024 be received for information.

  • THAT Report PWE-06-2025 Re 2024 Speed Radar Results be received by Council for information.

  • THAT Report CPS-09-2025 regarding Procurement Activity in 2024 be received for information.

  • THAT Council receive Report PWE 09-2025 re: Precast Culvert Tender Award for information;

    AND THAT Council award the Precast Culvert Tender to Coldstream Concrete Ltd. in the amount of $141,672.87 (Including municipal portion of nonrefundable HST);

    AND FURTHER THAT the Mayor and Clerk be authorized to execute any necessary purchase agreements with Coldstream Concrete Ltd.

  • THAT Report PWE 04 2025 re: be received;

    AND THAT the purchase of one (1) new FINN T-90S Hydro Seeder be awarded to Fibramulch in the amount of $113,608.42 (including municipal portion of nonrefundable HST);

  • THAT Report PWE 10-2025, re: Replacement Grader Award be received;

    AND THAT the purchase of a new John Deere 772GP grader be awarded to Brandt in the amount of $678,872.60 (including municipal portion of nonrefundable HST);

    AND FURTHER THAT the Mayor and Clerk be authorized to execute the necessary documents.

  • THAT Council passes a resolution in support of the requested exemption from the condominium approval process as set out in 9(6) and 9(10) of the Condominium Act for the lands legally described as 33M-836, Block 56, Municipality of Middlesex Centre, and that the resolution be forwarded to Middlesex County Council for consideration of the exemption request.

  • THAT Report FES-02-2025, regarding the Fire Services Master Plan Progress Update be received for information.

  • THAT report PWE 08- 2025 re: be received;

    AND THAT the purchase of (one) 1 new fire engine be awarded to Fort Gary in the amount of $692,104.00 (including municipal portion of nonrefundable HST);

  • THAT Zoning By-law Amendment application (ZBA-10-2022), filed by SBM Limited on behalf of JTW Farms Inc. and as amended by staff, to rezone the subject land from the ‘Agricultural (A1)’ zone to the ‘Farm Industrial exception 5 (M3-5)’ and ‘Agricultural exception 53 (A1-53)’ zones for the land legally described as Concession 14 S PT Lot 25 (former Township of London), Municipality of Middlesex Centre and known as 13326 Fourteen Mile Road, be APPROVED, and that the implementing By-law be forwarded to Council for consideration once a deposited reference plan has been provided to the satisfaction of the Municipality;

    AND THAT Zoning By-law Amendment application (ZBA-17-2024) for a temporary use zone, filed by SBM Limited on behalf of JTW Farms Inc., to permit two single-detached dwellings on one property for up to three years to allow a new residence to be constructed on the land known as 13326 Fourteen Mile Road, Municipality of Middlesex Centre, be APPROVED;

    AND THAT the owner be required to enter into a new Temporary Use Agreement with the Municipality and submit a deposit of $15,000 to ensure the removal of the existing residence or conversion in an office as an accessory use;

    AND THAT the Owner must also obtain a change of use permit to convert the existing dwelling into an office as an accessory use;

    AND THAT Consent Application B-17/2024, filed by SBM Limited on behalf of JTW Farms Inc. for lands legally described as Part of Lot 4, Concession 14 S PT Lot 25 (former Township of London), Municipality of Middlesex Centre and known as 13326 Fourteen Mile Road, be GRANTED subject to conditions;

    AND FURTHER THAT Consent B-17/2024 be subject to the following conditions:

    1. That the Certificate of Consent under Section 53(42) of the Planning Act shall be given within two years of the date of the notice of the decision. The request for the Certificate of Consent shall be accompanied by a written submission that details how each of the conditions of severance has been met.

       

    2. That the fee for the Certificate of Consent be paid in accordance with the Municipality’s Fees and Charges By-law.

       

    3. That a draft reference plan be prepared by an Ontario Land Surveyor for the purposes of facilitating the transaction of Consent B-17/2024 and that this plan be approved by the Municipality prior to being deposited with the Land Registry Office.

       

    4. That the Owner’s solicitor provide a Transfer in Preparation to the Municipality, together with a deposited reference plan and a Schedule describing the land to be transferred, for the purposes of the issuance of a Certificate of Consent.

       

    5. That the Owner’s solicitor submit an undertaking in a form satisfactory to the Municipality to register an electronic transfer of title consistent with the Consent decision.

       

    6. That any outstanding property taxes for the severed and retained lots of Consent B-17/2024 be paid in full.

       

    7. That, if necessary a revised assessment schedule in accordance with the Drainage Act, as amended, be commissioned and paid for by the Owner.

       

    8. That a Zoning By-law Amendment that recognizes the undersized nature of the remnant farm parcel and farm industrial use on the severed parcel of Consent B-17/2024 be in full force and effect.

       

    9. That the landowner obtain a change of use permit to convert the existing dwelling into an office as an accessory use.

       

    10. That a warning clause be registered on the title of the retained farm parcel of Consent B-17/2024 advising of elevated noise from the grain handling facility, to the satisfaction of the Municipality.

       

    11. That the severed land requires its own entrance, address and any laneway connecting the retained and severed land shall be altered in such a way that one cannot travel from one parcel of land to the other.

       

    12. That the hydro service for the severed lands be fully within the boundary of the proposed severed lot.

       

    13. That the owner pay a cash-in-lieu of parkland dedication in accordance with the Municipalities Fees and Charges By-law.

       

    14. That an address be assigned and number erected for the retained agricultural parcel.

       

    15. That the Owner will be required to dedicate lands up to 13 m from the centerline of construction of Hyde Park Road across the retained parcel to the Municipality of Middlesex Centre for the purposes of road widening if the right-of-way is not already to that width.

    AND FURTHER THAT the reasons for granting Consent Application B-17/2024 include:

    • The proposal is consistent with the Provincial Planning Statement, 2024;
    • The proposal conforms to the County of Middlesex Official Plan and the Middlesex Centre Official Plan; and
    • Subject to the conditions, the proposal would comply with the Middlesex Centre Comprehensive Zoning By-law.
  • THAT Council move into Public Meetings at ________pm pursuant to the Planning Act, R.S.O. 1990, as amended, to consider the applications listed on the February 26, 2025 Council agenda.

  • THAT Consent Application B-1/2025 filed by Perry Buren on behalf of Maria Buren in order to sever a lot with a frontage of approximately 20 m (65.6 ft) on Harris Road, and an area of approximately 0.67 ha (1.65 ac), and the retained frontage of approximately 34 m (111.5 ft) on Harris Road, and an area of approximately 0.2 ha (0.5 ac), for a property legally described as Plan 305 Pt Lot 2 RP 34R833 Part 1, in the Municipality of Middlesex Centre (former Township of Delaware), County of Middlesex, and is municipally known as 92 Harris Road; be GRANTED subject to conditions.

    AND THAT Consent B-1/2025 be subject to the following conditions:

    1. That the Certificate of Consent under Section 53(42) of the Planning Act shall be given within two years of the date of the notice of the decision. The request for the Certificate of Consent shall be accompanied by a written submission that details how each of the conditions of severance has been fulfilled.

       

    2. That the fee for the Certificate of Consent be paid in accordance with the Municipality’s Fees and Charges By-law.

       

    3. That a draft reference plan be prepared by an Ontario Land Surveyor for the purposes of facilitating the transaction of Consent B-1/2025, and that this plan be approved by the Municipality prior to being deposited with the Land Registry Office.

       

    4. That the Owner’s solicitor provide a Transfer in Preparation to the Municipality, together with a deposited reference plan and a Schedule describing the land to be transferred, for the purposes of the issuance of a Certificate of Consent.

       

    5. That the Owner’s solicitor submit an undertaking in a form satisfactory to the Municipality to register an electronic transfer of title consistent with the Consent decision.

       

    6. That the severed lot shall be serviced with Municipal water at the expense of the Owner prior to consent being granted to the satisfaction of the Municipality

       

    7. That the Owner provide confirmation that all services and the private sewage disposal system that services the residence on the retained and severed lots of Consent B-1/2025 is wholly contained on the said lot and that a 100% contingency area exists, to the satisfaction of the Municipality.

       

    8. That any outstanding property taxes for the severed and retained lots of Consent B-1/2025 be paid in full.

       

    9. That, if necessary a revised assessment schedule in accordance with the Drainage Act, as amended, be commissioned and paid for by the Owner.

       

    10. That the owner pay a cash-in-lieu of parkland dedication in the amount consistent with Municipalities Fee By-law.

       

    11. That the owner be required to pay $17,297.93 for future road upgrades.

       

    12. That, if necessary, the owner will be required to dedicate lands up to 10 m from the centerline of construction of Harris Road of the retained and severed parcels to the Municipality of Middlesex Centre for the purposes of road widening if the right of way is not already to that width.

       

    13. That a Zoning By-law Amendment that recognizes the residential use of the severed and retained parcels, and the reduced lot frontage of the severed parcel of Consent B-1/2025, including applicable holding provisions requiring a development agreement be in full force and effect.

       

    AND FURTHER THAT the reasons for granting Consent application B-1/2025 include:

    • The proposal is consistent with the Provincial Planning Statement;
    • The proposal conforms to the County of Middlesex Official Plan and the Middlesex Centre Official Plan; and
    • The proposal complies with the Middlesex Centre Comprehensive Zoning By-law.

       

     

    THAT Zoning By-law Amendment application ZBA-1-2025, as amended, filed by Perry Buren on behalf of Maria Buren, to rezone the subject land from the ‘Existing Use (EU)’ Zone to the ‘Community Residential First Density (CR1)’ and ‘Existing Use exception 5 (EU-5)’ Zones for the land legally described as Plan 305 PT Lot 2 RP 34R833 Part 1 and known as 92 Harris Road, Municipality of Middlesex Centre (former Township of Delaware), be APPROVED, and that the implementing By-law be forwarded to Council for consideration once a deposited reference plan has been provided to the satisfaction of the Municipality;

    AND THAT holding symbol (h-4) be applied to the lands zoned “Community Residential First Density (CR1)” of the severed lands of Consent application B-1-2025 to require a development agreement be entered into with the Corporation of the affected lands, be APPROVED.

  • THAT the public meetings adjourn at ____ pm and Council resume their regular meeting;

Being a by-law to amend the Middlesex Centre Comprehensive Zoning By-law number 2005-005 with respect to Concession 14 S PT Lot 25 (geographic Township of London), Municipality of Middlesex Centre, roll number: 393903409014802.

Being a By-law to adopt and confirm all actions and proceedings of the Council of the Municipality of Middlesex Centre at the Council meeting held on February 26, 2025.

  • THAT the Council for the Municipality of Middlesex Centre adjourns the February 26, 2025 Council meeting at ___ p.m.
