Mayor DeViet to call the meeting to order at 5:30 p.m. Members of the public are invited to participate in this meeting of Council by attending the meeting in-person at the Ilderton Community Centre located at 13168 Ilderton Rd, Ilderton, ON N0M 2A0.


Members of the public may also access the meeting which will be live-streamed on our Middlesex Centre YouTube channel or by contacting the Municipal Clerk to receive a registration link to join the meeting electronically.


Members of the public wishing to appear as a delegation can register for the meeting by visiting middlesexcentre.ca/participating-council-meetings or by contacting the Municipal Clerk at (519) 666-0190 by 4:30 p.m. on the Monday of the week of the scheduled meeting. All requests to delegate are subject to the provisions of the Middlesex Centre Procedure By-law.


Members of the public can choose to delegate in-person or by electronic participation. Accessible formats and communication supports are available upon request.

By-laws number 2024-091 (ZBA-13-2024), 2024-092 (ZBA-14-2024) and 2024-093 (ZBA-15-2024) have been removed and will be brought to a future meeting. 


 

The Municipal Conflict of Interest Act requires any member of Council declaring a pecuniary interest and the general nature thereof, where the interest of a member of Council has not been disclosed by reason of the member’s absence from the meeting, to disclose the interest at the first open meeting attended by the member of Council and otherwise comply with the Act.

The Engineer's Report for the Ilderton Municipal Drain No. 1 was previously considered at the July 3, 2024 meeting of Council. Members of the Court of Revision are Deputy Mayor Brennan, Councillor Aerts, and Councillor Shipley, with Deputy Mayor Brennan being the Chair.


The Court of Revision will proceed as follows:


1. CALL TO ORDER


All appeals are required to be received in writing 10 days prior to the date of the Court of Revisions as per the notice provided. 


2. ORDER OF APPEALS - no appeals received 


3. QUESTIONS FROM THE MEMBERS


Members of the Court of Revision may ask questions of the Engineer or staff. 


4. DELIBERATIONS OF THE COURT OF REVISION


The Court of Revision members (if required) will retreat to deliberate the appeals and make the decision in private. 


If the Court is considering reducing an assessment adding it to a property whose owner is not present, then the Court of Revision will adjourn and notice sent to the absent parties to allow them to appeal the change, then reconvene per s. 53 of the Act. 


5. DECISION


All parties to the drain will receive written notice of the Court of Revision decision which will contain additional information on the process to appeal the decision of the Court of Revision to the Ontario Drainage Tribunal.


6. ADJOURNMENT OF THE COURT OF REVISION

  • THAT the Middlesex Centre Court of Revision approves the Schedule of Assessment for the Ilderton Drain No. 1 provisionally adopted by By-Law 2024-061 as outlined in the report prepared by Spriet Associates;

    AND THAT the corresponding by-law be forwarded to Council for a final reading;

    AND FURTHER THAT the Court of Revision for the Ilderton Drain No. 1 adjourn at __________a.m.

THAT the minutes of the November 6, 2024 meeting of Council be adopted as printed.

Items listed under the Consent Agenda are received in one motion. Council members may request that one or more item be removed for further action.

  • THAT Consent items 7.1 through 7.6 listed on the November 20, 2024 agenda be adopted as recommended.

  • THAT the Third Quarter 2024 Building Activity Summary be received for information.

  • THAT Report CAO-30-2024 re: Expansion of Voyago Transit Services to Delaware be received for information.

  • THAT Report CAO-31-2024 re: Continuous Improvement Program for 2024 be received for information.

  • THAT the Budget to Actual Report CPS-53-2024 for October 2024 be received as information.

  • THAT Report PWE 56-2024, re: Komoka Wastewater Treatment Facility Phase Expansion – Schedule C Municipal Class Environmental Assessment award be received;

    AND THAT the project to complete the Schedule C Municipal Environmental Assessment for the phased expansion of the Komoka Wastewater Treatment Facility (WWTF) be awarded to Stantec Consulting Limited in the amount of $297,670.52 (exclusive of HST);

    AND FURTHER THAT the Mayor and Clerk be authorized to execute the necessary contract documents.

  • THAT Report CAO-32-2024 re: Lighting Retrofits to Ilderton Medical Clinic be received;

    AND THAT $35,000.00 be withdrawn from the Medical Centre Reserve Fund to proceed with lighting retrofits to the building as included in the 2025 Capital Budget.

  • THAT Report PWE 55-2024, re: 2025 Water, Wastewater and Stormwater Rate Proposal be received;

    AND THAT the 2025 water rates be increased 2% over the 2024 water rate;

    AND THAT the 2025 wastewater rates be increase 4% over the 2024 wastewater rate;

    AND FURTHER THAT the 2025 stormwater rates be increased 3% over the 2024 stormwater rates.

  • THAT Council move into public meetings at ________pm pursuant to the Planning Act, R.S.O. 1990, as amended, to consider the applications listed on the November 20, 2024 Council agenda.

  • THAT Zoning By-law Amendment Application (ZBA-11-2024), filed by Fourteen Mile Farms Ltd., to rezone the lands known as 12147 Greystead Drive from ‘Agricultural (A1)’ to ‘Surplus Residence (SR)’ and ‘Agricultural – No Residences (A3)’ for the severed and retained lands of consent application B-11/24, be APPROVED.

  • THAT Zoning By-law Amendment Application (ZBA-13-2024), filed by Lerners LLP on behalf of 1891958 Ontario Limited, to rezone the lands known as 10701 Lamont Drive from ‘Agricultural (A1)’ to ‘Surplus Residence (SR)’ and ‘Agricultural – No Residences (A3)’ for the severed and retained lands of consent application B-21/23, be APPROVED;

    AND THAT he implementing By-law be forwarded to Council for consideration once a deposited reference plan has been provided to the satisfaction of the Municipality.

  • THAT Zoning By-law Amendment Application (ZBA-14-2024), filed by Lerners LLP on behalf of 1891958 Ontario Limited, to rezone the lands known as 6069 Egremont Drive from ‘Agricultural (A1)’ to ‘Surplus Residence (SR)’ and ‘Agricultural – No Residences (A3)’ for the severed and retained lands of consent application B-22/23, be APPROVED;

    AND THAT the implementing By-law be forwarded to Council for consideration once a deposited reference plan has been provided to the satisfaction of the Municipality.

  • THAT Zoning By-law Amendment Application (ZBA-15-2024), filed by Lerners LLP on behalf of Ross James McLachlan, Katherine McLachlan & Stuart Donald McLachlan, to rezone the lands known as 9787 Ivan Drive from ‘Agricultural (A1)’ to ‘Surplus Residence exception 13 (SR-13)’ and ‘Agricultural – No Residences (A3)’ for the severed and retained lands of consent application B-23/23, be APPROVED;

    AND THAT the implementing By-law be forwarded to Council for consideration once a deposited reference plan has been provided to the satisfaction of the Municipality.

  • THAT Zoning By-law Amendment application (ZBA-16-2024) for a temporary use zone, filed by Craig Schroeder and Lori Lowes, to permit two single-detached dwellings on one property for up to three years to allow a new residence to be constructed on the land known as 25143 Poplar Hill Road, be APPROVED;

    AND THAT the owner be required to enter into a new Temporary Use Agreement with the Municipality and submit a deposit of $15,000 to ensure the removal of the existing residence.

  • THAT the public meetings adjourn at ____ pm and Council resume their regular meeting;

  • THAT the Correspondence items 12.1 through 12.3 be received as information.

  • WHEREAS official statistics from the Government of Ontario confirm that rural roads are inherently more dangerous than other roads;

    AND WHEREAS, despite only having 17% of the population, 55% of the road fatalities occur on rural roads;

    AND WHEREAS, rural, northern, and remote municipalities are fiscally strained by maintaining extensive road networks on a smaller tax base;

    AND WHEREAS, preventing crashes reduces the burden on Ontario's already strained rural strained health care system;

    AND WHEREAS, roadway collisions and associated lawsuits are significant factors in runaway municipal insurance premiums. Preventing crashes can have a significant impact in improving municipal risk profiles;

    THEREFORE, BE IT RESOLVED THAT the Municipality of Middlesex Centre requests that the Government of Ontario take action to implement the rural road safety program that Good Roads has committed to lead. It will allow Ontario's rural municipalities to make the critical investments needed to reduce the high number of people being killed and seriously injured on Ontario's rural roads; and

    FURTHER THAT a copy of this resolution be forwarded to Premier Doug Ford, Hon. Prabmeet Sarkaria, Minister of Transportation, Hon. King Surma, Minister of Infrastructure, Hon. Rob Flack, Minister of Agriculture, Hon. Lisa Thompson, Minister of Rural Affairs, Hon. Trevor Jones, Associate Minister of Emergency Preparedness and Response, and Hon. Sylvia Jones, Minister of Health, and Good Roads.

  • THAT the Council for the Municipality of Middlesex Centre adjourn to closed session at ________ pursuant to Section 239 (2) of the Municipal Act, 2001, as amended to discuss the following matters:

    Section 239 (2)(e)  litigation or potential litigation, including matters before administrative tribunals, affecting the municipality or local board (Current OLT Appeals Update);

Being a By-law to amend the Middlesex Centre Comprehensive Zoning By-law number 2005-005 with respect to Concession 11 N PT LOT 4 RP 33R373 PART 2 (geographic Township of Lobo), Municipality of Middlesex Centre, roll number: 393900003020101.
